We at Skillz Systems Incorporated recognize the importance of privacy and the sensitivity of personal information. Like most businesses, we have an obligation to keep confidential all information by which you or your child or other individuals can be identified. We are committed to protecting any personal information we receive. This privacy policy outlines how we manage personal information and safeguard privacy.

Your privacy rights

Since January 1, 2004, almost every Canadian business engaged in commercial activities has been required to comply with the Personal Information Protection and Electronic Documents Act. That Act gives rights concerning the privacy of personal information.

We are responsible for the personal information we collect and hold. To ensure this, we have developed this policy, and trained our representatives about our privacy policies and practices.

Why do we collect personal information?

We provide the hardware and software used in connection with the QuickStickz product. In order to continue to refine it and to provide our users with the best experience, we need to be able to access information about the users. We use some or all of that information we gather to tailor our software to fit a diverse range of personal characteristics and skill levels and to improve the user experience.

What personal information do we collect?

Personal information is any information that identifies an individual or by which an individual’s identity could be deduced. The personal information we require may include some or all of the following:

• Name, address, telephone number, age, height, weight and hockey experience of those using QuickStickz.
• Information regarding hockey experience. The term “hockey experience” includes the number of years played, teams played for, scores, and level of teams.
• Information about the usage of QuickStickz including without limitation the frequency and duration of use.

How do we collect personal information?

We collect information directly from you via the internet, email, phone or by other means identified to you.

Use of information

We use the personal information collected to:

• refine and develop our software and hardware;
• develop marketing material based on aggregate data;
• help us learn about our client base; and
• attempt to personalize the experience for our users.

Disclosure of personal information

We do not disclose personal information to any third parties to enable them to market their products and services.

We will disclose personal information when:

• required or authorized by law to do so;
• you have consented to the disclosure;
• we engage third parties to provide administrative services for us, such as computer back-up services or archival file storage; and
• the information is already publicly known.

Retention of the personal information

We will keep records for up to 5 years after the information in your account becomes inactive and you do not reactivate it. Your account will become inactive if you breach the terms of the End User License Agreement or if you cancel your account. This allows us ample time with which to use the information for the purposes of software development.

Is the personal information secure?

We will employ all reasonable safeguards to ensure that the personal information is kept safe from loss, unauthorized access, modification or disclosure. Among the steps taken to protect the information are:

• restricted access to personal information;
• deploying technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access;
• internal password and security policies.

Communicating with Users

Normally, we communicate with users by email and by telephone. Unless we are otherwise instructed, we will only leave our name and telephone number if we are required to leave a message for you.

Access to personal information

You may ask for access to any personal information we hold about you. Summary information is available on request.

Denial of access to personal information

Your right to access your personal information is not absolute. We may deny access when:

• denial is required or authorized by law;
• granting access would have an unreasonable impact on other people's privacy;
• it is necessary to protect our rights and property;
• where the request is frivolous or vexatious.
• If we deny your request for access to, or refuse a request to correct information, we will explain our reasoning in writing.
